COPYRIGHTS

 

Copyright is a form of protection provided by the laws of the United States under Title 17, to authors of original works of authorship, including literary, dramatic, musical, artistic and certain other intellectual works.  This protection is available to published and unpublished works.   In general, the Copyright Act gives the owner of a copyright the exclusive right to: (1) Reproduce the copyrighted work, (2) Prepare derivative works based upon the copyrighted work, (3) Distribute copies of the copyrighted work to the public by sale or other transfer of ownership, (4) Perform the copyrighted work publicly, and (5) Display the copyrighted work publicly.

 

Title 17, protects original works of authorship that are fixed in tangible forms of expression. Copyrightable works include literary works; musical works; dramatic works; pantomimes and choreographic works; pictorial, graphic and sculptural works; motion pictures and audiovisual works; sound recordings; and architectural works.

TRADE SECRETS

 

A trade secret is information that is not known or readily available to a competitor. A trade secret can consist of any formula, pattern, device, or compilation of information that is used in one's business and provides an opportunity to obtain a business advantage. Trade secrets differ from other types of intellectual property in that a trade secret can exist indefinitely, as long as the secret information is kept in confidence. In contrast, patents, trademarks and copyrights can eventually become available to the public. Trade secret theft can result in both civil and criminal penalties.
